He described himself as a \u201cheavy smoker,\u201d noting he almost always finished a pack a day and would smoke more than 30 cigarettes a day on a \u201cbusy\u201d day.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For Hasnain, quitting smoking was not a health-based decision. He did it because it was convenient.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In May, 1988, Canada enacted the Non-Smokers Health Act. It was the first legislation that recognized and aimed to prevent the harm caused by second-hand smoke. The act forbade smokers from smoking in federal buildings and in transportation vehicles the government\u00a0had jurisdiction over\u2014 such as airplanes, ships and trains. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The exemption for these bans was that smokers were allowed to smoke in allocated smoking sections. In 1994, Canada became the first country worldwide to ban smoking on all of flights.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the 2000s,<\/span><a href=\"http:\/\/www.statcan.gc.ca\/pub\/82-003-x\/2006008\/article\/smoking-tabac\/t\/4060721-eng.htm\">\u00a0<span style=\"font-weight: 400;\">provinces<\/span><\/a><span style=\"font-weight: 400;\"> also passed legislation to ban smoking from restaurants, bars, and patios.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hasnain immigrated to Canada in 2013.<\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][et_pb_column type=&#8221;1_2&#8243;][et_pb_blurb admin_label=&#8221;Blurb&#8221; url_new_window=&#8221;off&#8221; use_icon=&#8221;off&#8221; icon_color=&#8221;#7EBEC5&#8243; use_circle=&#8221;off&#8221; circle_color=&#8221;#7EBEC5&#8243; use_circle_border=&#8221;off&#8221; circle_border_color=&#8221;#7EBEC5&#8243; icon_placement=&#8221;top&#8221; animation=&#8221;top&#8221; background_layout=&#8221;light&#8221; text_orientation=&#8221;left&#8221; use_icon_font_size=&#8221;off&#8221; use_border_color=&#8221;off&#8221; border_color=&#8221;#ffffff&#8221; border_style=&#8221;solid&#8221; body_font_size=&#8221;24&#8243; body_text_color=&#8221;#000000&#8243; header_font=&#8221;Georgia||||&#8221;]<\/p>\n<blockquote>\n<h5><em>It felt as if I was smoking carbon. I just said like&#8230;oh my God, what have I been doing in the past.<\/em><\/h5>\n<h5><span class=\"et_quote_name\">\u2013Ghulam Hasnain<\/span><\/h5>\n<\/blockquote>\n<hr \/>\n<p>[\/et_pb_blurb][et_pb_code admin_label=&#8221;Code&#8221;]&lt;iframe width=&#8221;1280&#8243; height=&#8221;720&#8243; src=&#8221;https:\/\/www.youtube.com\/embed\/Reo6LgWhbr8?rel=0&amp;amp;controls=0&amp;amp;showinfo=0&#8243; frameborder=&#8221;0&#8243; allowfullscreen&gt;&lt;\/iframe&gt;[\/et_pb_code][\/et_pb_column][\/et_pb_row][et_pb_row admin_label=&#8221;Row&#8221;][et_pb_column type=&#8221;4_4&#8243;][et_pb_text admin_label=&#8221;Text&#8221; background_layout=&#8221;light&#8221; text_orientation=&#8221;left&#8221; use_border_color=&#8221;off&#8221; border_color=&#8221;#ffffff&#8221; border_style=&#8221;solid&#8221;]<\/p>\n<p><span style=\"font-weight: 400;\">\u201cWhen I moved to Canada I came to know that these things were quite regulated over here and these [tobacco cigarettes] are not cheap at all,\u201d Hasnain says.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hasnain\u2019s wife forbids\u00a0him from smoking tobacco cigarettes in the house.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe home and work environments are not such that you can smoke inside\u2014you have to go outside&#8230; and brave the weather,\u201d he says.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hasnain tried to quit by using the patches and gums, which he says gave him stomach pains and caused his teeth to turn yellow.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nicotine patches, gums or lozenges deliver nicotine through the skin or orally. Common side effects from these products include headaches, nausea and indigestion. Lozenges and gums can cause yellowing of teeth and in rare cases cracking of the teeth, though this is usually because the user is consuming or absorbing a substantial amount of nicotine.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It was a coincidence that the father of two children saw an opening for an accountant for cardiologist and vape shop owner Gopal Bhatnagar\u2019s newly established online company 180Smoke.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">His colleagues at his new job asked him to try vaping. After a week of vaping, the long-time cigarette addict tried a cigarette.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIt felt as if I was smoking carbon,\u201d says Hasnain. \u201cI couldn\u2019t take it anymore. I just said\u00a0like&#8230; oh my God, what have I been doing in the past.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hasnain says the switch to vaping changed life at home. He described how his children use to follow him to the balcony and catch him smoking.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThey\u2019d follow me and would say \u2018hey dad why are you smoking again. Man. That\u2019s not on\u2019,\u201d he says about sneaking around his house when lighting up a tobacco cigarette.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Instead, he says, he can vape in his house and his wife and children are happy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Still, Hasnain says he would never vape beside someone who was uncomfortable with the idea of an e-cigarette.<\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row admin_label=&#8221;Row&#8221;][et_pb_column type=&#8221;2_3&#8243;][et_pb_text admin_label=&#8221;Text&#8221; background_layout=&#8221;light&#8221; text_orientation=&#8221;left&#8221; use_border_color=&#8221;off&#8221; border_color=&#8221;#ffffff&#8221; border_style=&#8221;solid&#8221;]<\/p>\n<h2><b>Vaping in public<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">\u201cIn public I would not. I would not go out in public and start throwing my vape on somebody\u2019s face. I would not,\u201d says Hasnain.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When it comes to where people are allowed to vape, it\u2019s really quite simple \u2014 it\u2019s either nowhere or everywhere.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Most provinces have banned vaping in public areas. This means vapers are not allowed to vape in spaces where smoking is not permitted. Saskatchewan, Alberta, Newfoundland and Labrador as well as the Yukon have no regulations about about vaping in public.<br \/>\n<\/span><\/p>\n<p><b>See chapter <a href=\"http:\/\/cusjc.ca\/healthycigs\/canadian-context\/\">Canadian Context <\/a>for more.<br \/>\n<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Generally, vapers cannot vape in restaurants and bars. In some provinces this extends to patios and terraces.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In British Columbia, vaping is illegal inside public buildings and on patios. As with cigarettes, e-cigarette usage in apartments, condos and parks depends on relevant local bylaws.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Alberta has no province-wide regulation on where e-cigarettes can and cannot be smoked. As a result, several municipalities &#8211; including Calgary, Edmonton and Red Deer &#8211; have taken matters into their own hands, drafting bylaws restricting vaping.<\/span><a href=\"http:\/\/www.calgary.ca\/CSPS\/ABS\/Pages\/Bylaws-by-topic\/Smoking.aspx\"> <span style=\"font-weight: 400;\">Calgary<\/span><\/a><span style=\"font-weight: 400;\"> and<\/span><a href=\"http:\/\/www.edmonton.ca\/bylaws_licences\/bylaws\/smoking.aspx\"> <span style=\"font-weight: 400;\">Edmonton<\/span><\/a><span style=\"font-weight: 400;\"> passed bylaws banning e-cigarettes in all the same places tobacco is banned &#8211; including restaurants, bars and patios.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In Prince Edward Island,\u00a0both cigarettes and e-cigarettes are banned from restaurants and patios, with the exception of 10 p.m. to 3 a.m. on patios. It also bars vaping on construction sites.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nova Scotia and Quebec banned vaping in all restaurants and bar, including patios. In New Brunswick, users cannot be within 9 metres of the terrace.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In Manitoba, vaping is banned in public places such as offices, restaurants and bars. There is no ban on smoking on patios or outdoor spaces. [Photo courtesy \u00a9 Mike Mozart at Flickr] [\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row admin_label=&#8221;Row&#8221;][et_pb_column type=&#8221;1_2&#8243;][et_pb_text admin_label=&#8221;Text&#8221; background_layout=&#8221;light&#8221; text_orientation=&#8221;left&#8221; use_border_color=&#8221;off&#8221; border_color=&#8221;#ffffff&#8221; border_style=&#8221;solid&#8221;]<\/p>\n<p>While restaurants are subject to municipal and provincial legislation, airlines, trains and buses have been given final say on how electronic cigarettes should be regulated, because there have been no direct orders for regulation Transport Canada.<\/p>\n<p><span style=\"font-weight: 400;\">In February 2015, <\/span><a href=\"https:\/\/www.tc.gc.ca\/eng\/tdg\/publications-alerts-menu-1223.html\"><span style=\"font-weight: 400;\">Transport Canada<\/span><\/a> <span style=\"font-weight: 400;\">issued an advisory to airlines not to allow vapers to carry their electronic cigarettes in their checked baggage.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cElectronic cigarettes are being carried by passengers in increasing numbers. Several incidents have been reported involving e-cigarettes overheating through the accidental activation of their heating elements resulting in fires in checked baggage,\u201d wrote Transport Canada in a statement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While e-cigarettes are not allowed in checked baggage,<\/span><a href=\"http:\/\/www.aircanada.com\/en\/travelinfo\/airport\/baggage\/carry-on.html\"> <span style=\"font-weight: 400;\">Air Canada<\/span><\/a><span style=\"font-weight: 400;\">,<\/span><a href=\"https:\/\/www.westjet.com\/mobile\/en\/travel\/basics\/baggage\/carry-on.shtml\"> <span style=\"font-weight: 400;\">West Jet<\/span><\/a><span style=\"font-weight: 400;\">,<\/span><a href=\"http:\/\/www.airtransat.com\/en-CA\/Travel-information\/Baggage\/Dangerous-goods-Restricted-prohibited\"><span style=\"font-weight: 400;\"> Air Transat<\/span><\/a><span style=\"font-weight: 400;\">, and<\/span><a href=\"http:\/\/www.flysunwing.com\/travelinfo\/baggageinfo.asp\"> <span style=\"font-weight: 400;\">Sunwing Airlines<\/span><\/a><span style=\"font-weight: 400;\"> allow passengers to carry e-cigarettes but they cannot be used on board.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Canadian Air Transport Security Authority (CATSA) allows vapers to bring e-cigarettes for personal use in their carry-on luggage or &#8220;on your person&#8221;. There are\u00a0also strict instructions for how e-cigarette\u00a0batteries are stored, while on a plane.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cSpare batteries must be protected so they won\u2019t short-circuit. He\u2019s afraid \u201cenclosed spaces\u201d may include his vape shop.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Some provinces have indeed banned the use of vaporizers and e-cigarettes inside public places. This means that vape shops are banned from allowing the customer to try vaping inside the shop.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lacombe was a smoker for 25 years. \u00a0He quit smoking the day he tried an e-cigarette. He was so pleased that he decided to work for E-steam in Ottawa. E-steam is an Ottawa-based online e-cigarette retailer. There are also nine physical E-steam stores; eight in the Ottawa area and one in Kingston.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In June 2015, Lacombe\u00a0opened his own shop called Tugboat Vaping &amp; Co.. Originally, it was located in a mall, but the vape shop owner was asked to leave the private property by the owners because they no longer wanted to have people vape inside the mall. The Sarnia mall acted pre-emptively before the Ontario legislation came out.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWhat could I do? It\u2019s a private company. They can do what they want. So I moved,\u201d said Lacombe.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The vaping ban inside vape shops is already a reality in several provinces with regulations that treat e-cigarettes like tobacco.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lacombe says nobody disagreed with the ban on selling to minors or preventing the use of e-cigarettes in public spaces. While he was not happy about leaving the mall, he did so without too much of a fight.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cBut am I going to fight for my right to vape in my own store [which is not in a mall]? In 2014, the number dropped to 18.1 percent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Where it did increase quite dramatically is in Nunavut. In 2009, more than half of the population, 54.4 per cent, reported smoking regularly. By 2014, 60.2 per cent of the population considered themselves smokers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The World Health Organization estimates that seventy per cent of the deaths related to tobacco products occur in<\/span><a href=\"http:\/\/www.who.int\/trade\/glossary\/story089\/en\/\"> <span style=\"font-weight: 400;\">developing countries<\/span><\/a><span style=\"font-weight: 400;\">. Those in<\/span><a href=\"http:\/\/www.statcan.gc.ca\/pub\/82-624-x\/2012001\/article\/11676-eng.htm\"> <span style=\"font-weight: 400;\">lower-income<\/span><\/a><span style=\"font-weight: 400;\"> families, including young people, are more likely to smoke.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So why not just ban tobacco cigarettes altogether and prescribe electronic cigarettes to people who want to overcome the addiction?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bhatnagar thinks one of the reasons for this is at least in part because of money.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2014 the federal government made almost $3.3 billion from tobacco taxes, according to<\/span><a href=\"http:\/\/www.smoke-free.ca\/pdf_1\/totaltax.pdf\"> <span style=\"font-weight: 400;\">Physicians for a Smoke Free Canada<\/span><\/a><span style=\"font-weight: 400;\">. Including provincial taxes on tobacco the total was more than $8 billion.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cUnfortunately, tobacco use was widely established before its tragic health consequences became known,\u201d wrote Sara Lauer, spokesperson for Health Canada, in an email, after being asked why the government does not simply ban tobacco.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe idea of banning cigarettes in Canada was first examined in the early 1960s. Today, as in the 1960\u2019s, a ban on tobacco products would be extremely difficult to introduce and enforce, given that tobacco is used by millions of Canadians, many of whom are addicted,\u201d Lauer says.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While smoking rates in Canada have dropped it would be misguided to think Big Tobacco is out for good. The optics of having Tobacco industry involved in the e-cigarettes business makes one question its intentions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Despite his explicit hatred for the Tobacco industry Bhatnagar thinks he would be able to forgive them if they invested in e-cigarettes and moved away from tobacco.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWhen people don\u2019t know, you must respect that and educate them some other way,\u201d says Hasnain.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\f<\/span><\/p>\n<p>[\/et_pb_text][et_pb_text admin_label=&#8221;Text&#8221; background_layout=&#8221;light&#8221; text_orientation=&#8221;left&#8221; use_border_color=&#8221;off&#8221; border_color=&#8221;#ffffff&#8221; border_style=&#8221;solid&#8221;]<\/p>\n<h2><b>More than addicts<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">E-cigarette users are not just smokers looking to quit smoking.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A most recent<\/span><a href=\"http:\/\/www.sciencedirect.com\/science\/article\/pii\/S0306460316301113\"> <span style=\"font-weight: 400;\">study<\/span><\/a><span style=\"font-weight: 400;\"> on e-cigarettes suggests they can help people with serious mental illnesses quit smoking\u2014such as schizophrenia or bipolar disorder. According to the study, people with serious mental illnesses have a harder time quitting than people without mental illnesses and may find it more difficult to quit through conventional nicotine replacement therapy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to 180smoke salesperson Keith Hucher, e-cigarettes have the potential\u00a0help non-smokers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">He says ex-smokers who feel\u00a0the urge to smoke come into the shop. He also says asthmatic smokers or diabetics looking for a sweet taste have wanted to try to vape.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Considering this, and the fact that most vapers are trying to get away from smoking, segregating vapers and asking them to sit at the smokers table may not be the best solution for public health.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">David Sweanor compared sending vapers to a smoking section, to sending a recovering alcoholic to an AA meeting at a bar during happy hour.<\/span><\/p>\n<p>[\/et_pb_text][et_pb_text admin_label=&#8221;Text&#8221; background_layout=&#8221;light&#8221; text_orientation=&#8221;left&#8221; use_border_color=&#8221;off&#8221; border_color=&#8221;#ffffff&#8221; border_style=&#8221;solid&#8221;]<\/p>\n<p><span style=\"font-weight: 400;\">The electronic cigarette as a tool is not the issue and e-cigarettes have shown potential to be a form of harm reduction. Instead, the problem is that unlike bottles of alcohol or needles which deliver the drug to the individual user, vaping is invasive and affects the public.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Yet, it would be misleading treat vapour the same way as tobacco smoke, because as Sweanor says it delivers a public message that vapour is as harmful as tobacco smoke. Still, because little is still known about the new product it is better to be safe than sorry.\u00a0<\/span><span style=\"font-weight: 400;\">A\u00a0possible compromise is, much safe injection sites, vapers could be given designated areas to vape.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A report done by the Propel Centre for Population Health Impact found the top three reasons for using e-cigarettes were to replace regular tobacco cigarettes, to quit smoking, and <\/span>t<span style=\"font-weight: 400;\">he limited restrictions on where they could vape versus smoking. The 2013 study was done before there were regulations on e-cigarettes and so there were more places available to vape.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-484\" src=\"http:\/\/cusjc.ca\/healthycigs\/wp-content\/uploads\/2016\/04\/addicts-photo.jpg\" alt=\"addicts photo\" width=\"600\" height=\"337\" srcset=\"https:\/\/cusjc.ca\/healthycigs\/wp-content\/uploads\/2016\/04\/addicts-photo.jpg 1280w, https:\/\/cusjc.ca\/healthycigs\/wp-content\/uploads\/2016\/04\/addicts-photo-300x169.jpg 300w, https:\/\/cusjc.ca\/healthycigs\/wp-content\/uploads\/2016\/04\/addicts-photo-768x432.jpg 768w, https:\/\/cusjc.ca\/healthycigs\/wp-content\/uploads\/2016\/04\/addicts-photo-1024x576.jpg 1024w, https:\/\/cusjc.ca\/healthycigs\/wp-content\/uploads\/2016\/04\/addicts-photo-1080x608.jpg 1080w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><span style=\"font-weight: 400;\">For some, like Michael Hampartzoumian, Ghulam Hasnain and Adey Bailey, e-cigarettes were the only tool that helped them overcome the temptation and habit of smoking tobacco cigarettes. It halted their addiction to tobacco cigarettes and helped them control their nicotine addiction.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This project highlighted smokers as addicts struggling with an illness. For some, e-cigarettes help control their nicotine addiction and is a form of harm reduction.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The debate is about regulation and specifically what should be regulated. For vapers, it\u2019s about what is in the product: what exactly is in the\u00a0e-juice and how safe is their electronic device. For non-smoker advocate groups it\u2019s having a clean air environment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Still, some scholars like Stanton Glantz worry that future studies will reveal the dangers of e-cigarettes. This same fear has caused Health Canada to remain noncommittal to classifying e-cigarettes as a \u201csmoking alternative.\u201d<\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row admin_label=&#8221;Row&#8221;][et_pb_column type=&#8221;3_4&#8243;][et_pb_text admin_label=&#8221;Text&#8221; background_layout=&#8221;light&#8221; text_orientation=&#8221;left&#8221; use_border_color=&#8221;off&#8221; border_color=&#8221;#ffffff&#8221; border_style=&#8221;solid&#8221;]<\/p>\n<h2><b>Addicts<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">People suffering from the damages of smoking have filed lawsuits against Big Tobacco. Most recently the Quebec Superior Court ruled against the three biggest tobacco companies in Quebec, in a province-wide class action-suit. The court ruled that the tobacco companies failed to warn users of the health risks associated with smoking.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">During the lawsuit, tobacco companies claimed that the Federal Government was also liable, as it too failed to warn the general public of smoking\u2019s damaging effects. The Supreme Court of Canada rejected this claim,<\/span><a href=\"http:\/\/scc-csc.lexum.com\/scc-csc\/scc-csc\/en\/item\/7957\/index.do\"> <span style=\"font-weight: 400;\">ruling<\/span><\/a><span style=\"font-weight: 400;\"> that the Federal Government could not be held liable for policy decisions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ultimately, Imperial Tobacco, Rothmans Benson &amp; Hedges and JTI-MacDonald were ordered to pay the plaintiffs a total of $15 billion in damages. The due date for payment is<\/span><a href=\"http:\/\/www.cqts.qc.ca\/recours\/wp-content\/uploads\/2015\/10\/Jugement__500-09-025385-154__27_octobre_2015_.pdf\"> <span style=\"font-weight: 400;\">June 2017<\/span><span style=\"font-weight: 400;\">.<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400;\">The money will be distributed to two groups. The first is for smokers who developed a serious disease from smoking. Lung and throat cancer patients or their beneficiaries will be awarded $80,000 to $100,000. Patients with emphysema will be rewarded $24 000 to 30 000$. There were approximately 100,000 plaintiffs with emphysema or cancer.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The second plaintiffs were 918, 218 smokers who are unable to quit smoking are going to be given approximately $130 each.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If smokers are addicts who are struggling with an addiction and they want to use electronic cigarettes in public should that be allowed? The idea of having a someone vaping next to a non-smoker on an airplane or bus seems regressive after many years of work to limit smoking in public and counter the damaging first- and second-hand effects of cigarettes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Do the rights of the majority and general protection for non-smokers supersede those of the minority in the vaping community?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Helping smokers quit tobacco cigarettes by vaping, as mentioned, could be seen as a potential harm reduction method. He described himself as a \u201cheavy smoker\u201d, noting he almost always finished a pack a day and would smoke more than 30 cigarettes a day on a \u201cbusy\u201d day.<\/span><\/p><p><span style=\"font-weight: 400;\">For Hasnain, quitting smoking was not a health-based decision. He did it because it was convenient.<\/span><\/p><p><span style=\"font-weight: 400;\">In May, 1988, Canada enacted the Non-Smokers Health Act. It was the first legislation that recognized and aimed to prevent the harm caused by second-hand smoke. The act forbade smokers from smoking in federal buildings and in transportation vehicles it had jurisdiction over such as airplanes, ships and trains. The exemption for these bans was that smokers were allowed to smoke in allocated smoking sections. In 1994, Canada became the first country worldwide to ban smoking on all of flights.<\/span><\/p><p><span style=\"font-weight: 400;\">In the 2000s<\/span><a href=\"http:\/\/www.statcan.gc.ca\/pub\/82-003-x\/2006008\/article\/smoking-tabac\/t\/4060721-eng.htm\"> <span style=\"font-weight: 400;\">provinces<\/span><\/a><span style=\"font-weight: 400;\"> also passed legislation to ban smoking from restaurants, bars, and patios.<\/span><\/p><p><span style=\"font-weight: 400;\">Hasnain immigrated to Canada in 2013.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cWhen I moved to Canada I came to know that these things were quite regulated over here and these [tobacco cigarettes] are not cheap at all,\u201d Hasnain says.<\/span><\/p><p><span style=\"font-weight: 400;\">Hasnain\u2019s wife forbid him from smoking tobacco cigarettes in the house.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cThe home and work environments are not such that you can smoke inside--you have to go outside...and brave the weather,\u201d he says.<\/span><\/p><p><span style=\"font-weight: 400;\">Hasnain tried to quit by using the patches and gums, which he says gave him stomach pains and caused his teeth to turn yellow.<\/span><\/p><p><span style=\"font-weight: 400;\">Nicotine patches, gums or lozenges deliver nicotine through the skin or orally. Common side effects from these products include headaches, nausea and indigestion. Lozenges and gums can cause yellowing of teeth and in rare cases cracking of the teeth, though this is usually because the user is consuming or absorbing a substantial amount of nicotine.<\/span><\/p><p><span style=\"font-weight: 400;\">It was then pure coincidence that the father of two children saw an opening for an accountant for cardiologist and vape shop owner Gopal Bhatnagar\u2019s newly established online company 180Smoke.<\/span><\/p><p><span style=\"font-weight: 400;\">His colleagues at his new job asked him to try vaping. After a week of vaping, the long-time cigarette addict tried a cigarette.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cIt felt as if I was smoking carbon,\u201d says Hasnain. \u201cI couldn\u2019t take it anymore. I just says like. Oh my God what have I been doing in the past.\u201d<\/span><\/p><p><span style=\"font-weight: 400;\">Hasnain says the switch to vaping changed life at home. He described how his children use to follow him to the balcony and catch him smoking.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cThey\u2019d follow me and would say \u2018hey dad why are you smoking again. Man. That\u2019s not on\u2019,\u201d he says about sneaking around his house when lighting up a tobacco cigarette.\u201d<\/span><\/p><p><b>VIDEO HASNAIN<\/b><\/p><p><span style=\"font-weight: 400;\">Instead, he says, he can vape in his house and his wife and children are happy.<\/span><\/p><p><span style=\"font-weight: 400;\">Still, Hasnain says he would never vape beside someone who was uncomfortable with the idea of an e-cigarette.<\/span><\/p><p><b>VAPING IN PUBLIC<\/b><\/p><p><span style=\"font-weight: 400;\">\u201cIn public I would not. I would not go out in public and start throwing my vape on somebody\u2019s face. I would not,\u201d says Hasnain.<\/span><\/p><p><span style=\"font-weight: 400;\">When it comes to where people are allowed to vape, it\u2019s really quite simple \u2014 it\u2019s either nowhere or everywhere.<\/span><\/p><p><span style=\"font-weight: 400;\">Most provinces have banned vaping in public areas. This means vapers are not allowed to vape in spaces where smoking is not permitted. Saskatchewan, Alberta, Newfoundland and Labrador as well as the Yukon have no regulations about about vaping in public.<\/span><\/p><p><b>(SEE CHAPTER 2 FOR MORE\u2192 there will be a link to chap. 2)<\/b><\/p><p><b>WIKI COMMONS IMAGE OF NO SMOKING, NO VAPING<\/b><\/p><p><span style=\"font-weight: 400;\">Generally, vapers cannot vape in restaurants and bars and in some provinces they cannot vape on terraces.<\/span><\/p><p><span style=\"font-weight: 400;\">In British Columbia, vaping is illegal inside public buildings and on patios. As is the case with cigarettes, e-cigarette usage in apartments, condos and parks depends on relevant local bylaws.<\/span><\/p><p><span style=\"font-weight: 400;\">Alberta has no province-wide regulation on where e-cigarettes can and cannot be smoked. As a result, several municipalities - including Calgary, Edmonton and Red Deer - have taken matters into their own hands, drafting bylaws restricting vaping.<\/span><a href=\"http:\/\/www.calgary.ca\/CSPS\/ABS\/Pages\/Bylaws-by-topic\/Smoking.aspx\"> <span style=\"font-weight: 400;\">Calgary<\/span><\/a><span style=\"font-weight: 400;\"> and<\/span><a href=\"http:\/\/www.edmonton.ca\/bylaws_licences\/bylaws\/smoking.aspx\"> <span style=\"font-weight: 400;\">Edmonton<\/span><\/a><span style=\"font-weight: 400;\"> passed bylaws banning e-cigarettes in all the same places tobacco is banned - including restaurants, bars and patios.<\/span><\/p><p><span style=\"font-weight: 400;\">In P.E.I both cigarettes and e-cigarettes are banned from restaurants and patios, with the exception of 10 p.m. to 3 a.m. on patios. It also bars vaping on construction sites.<\/span><\/p><p><span style=\"font-weight: 400;\">Nova Scotia and Quebec banned vaping in all restaurants and bars and respective patios. In New Brunswick users cannot be within 9 metres of the terrace.<\/span><\/p><p><span style=\"font-weight: 400;\">In Manitoba, vaping is banned in public places such as offices, restaurants and bars. There is no ban on smoking on patios or outdoor spaces. E-cigarettes are therefore permissible on patios.<\/span><\/p><p><span style=\"font-weight: 400;\">Saskatchewan and Newfoundland and Labrador have no bans for vaping on patios, though Saskatoon does.<\/span><\/p><p><b>IMAGE OF PLANE<\/b><\/p><p><span style=\"font-weight: 400;\">While restaurants are subject to municipal and provincial legislation, airlines, trains and buses have been given final say on how electronic cigarettes should be regulated, because there have been no direct orders for regulation Transport Canada.<\/span><\/p><p><span style=\"font-weight: 400;\">In February 2015, <\/span><a href=\"https:\/\/www.tc.gc.ca\/eng\/tdg\/publications-alerts-menu-1223.html\"><span style=\"font-weight: 400;\">Transport Canada<\/span><\/a> <span style=\"font-weight: 400;\">issued an advisory to airlines not to allow vapers to carry their electronic cigarettes in their checked baggage.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u201cElectronic cigarettes are being carried by passengers in increasing numbers. Several incidents have been reported involving e-cigarettes overheating through the accidental activation of their heating elements resulting in fires in checked baggage,\u201d wrote Transport Canada in a statement.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">While, e-cigarettes are not allowed in checked baggage<\/span><a href=\"http:\/\/www.aircanada.com\/en\/travelinfo\/airport\/baggage\/carry-on.html\"> <span style=\"font-weight: 400;\">Air Canada<\/span><\/a><span style=\"font-weight: 400;\">,<\/span><a href=\"https:\/\/www.westjet.com\/mobile\/en\/travel\/basics\/baggage\/carry-on.shtml\"> <span style=\"font-weight: 400;\">West Jet<\/span><\/a><span style=\"font-weight: 400;\">,<\/span><a href=\"http:\/\/www.airtransat.com\/en-CA\/Travel-information\/Baggage\/Dangerous-goods-Restricted-prohibited\"><span style=\"font-weight: 400;\"> Air Transat<\/span><\/a><span style=\"font-weight: 400;\">, and<\/span><a href=\"http:\/\/www.flysunwing.com\/travelinfo\/baggageinfo.asp\"> <span style=\"font-weight: 400;\">Sunwing Airlines<\/span><\/a><span style=\"font-weight: 400;\"> allow passengers to carry e-cigarettes but they cannot be used on board.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">The Canadian Air Transport Security Authority (CATSA) allows vapers to bring e-cigarettes for personal use in their carry-on luggage or on your person. There is also strict instructions for how its batteries are stored while on a plane.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cSpare batteries must be protected so they won\u2019t short-circuit. You are not allowed to recharge the e-cigarettes and\/or batteries while you are on board the aircraft.\u201d<\/span><\/p><p><a href=\"http:\/\/www.viarail.ca\/en\/travel-info\/onboard-train\/policies\"><span style=\"font-weight: 400;\">Via Rail<\/span><\/a><span style=\"font-weight: 400;\"> and Greyhound do not permit travellers to vape inside their vehicles.<\/span><\/p><p><b>AUDIO LACOMBE<\/b><\/p><p><span style=\"font-weight: 400;\">One of the growing concerns for Sarnia vape shop owner Martin Lacombe is that people will not be allowed to test the product in his vape shop, because vaping in enclosed spaces may be banned under the new Ontario regulations. He\u2019s afraid \u201cenclosed spaces\u201d may include his vape shop.<\/span><\/p><p><span style=\"font-weight: 400;\">Some provinces have indeed banned the use of vaporizers and e-cigarettes inside public places. This means that vape shops are banned from allowing the customer to try vaping inside the shop.<\/span><\/p><p><span style=\"font-weight: 400;\">Lacombe was a smoker for 25 years. \u00a0He quit smoking the day he tried an e-cigarette. He was so pleased that he decided to work for E-steam in Ottawa. E-steam is an Ottawa-based online e-cigarette retailer. There are also nine physical E-steam stores; eight in the Ottawa area and one in Kingston.<\/span><\/p><p><span style=\"font-weight: 400;\">In June 2015, Martin opened his own shop called Tugboat Vaping & Co. Originally, it was located in a mall, but the vape shop owner was asked to leave the private property by the owners because of they no longer wanted to have people vape inside the mall. The Sarnia mall acted pre-emptively before the Ontario legislation came out.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cWhat could I do. It\u2019s a private company. They can do what they want. So I moved,\u201d said Lacombe.<\/span><\/p><p><span style=\"font-weight: 400;\">The vaping ban inside vape shops is already a reality in several provinces with regulations that treat e-cigarettes like tobacco.<\/span><\/p><p><span style=\"font-weight: 400;\">Lacombe says nobody disagreed with the ban on selling to minors or preventing the use of the e-cigarette in public spaces and while he was not happy about leaving the mall, he did without too much of a fight.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cBut am I going to fight for my right to vape in my own store [which is not in a mall]? Hell yeah I am,\u201d says Lacombe, as he vaped on an e-cigarette.<\/span><\/p><p>\u00a0<\/p><p><b>STOPPING TOBACCO<\/b><\/p><p><span style=\"font-weight: 400;\">Tobacco product use is the number one cause of preventable death in Canada. Although the rate of smoking in has dropped dramatically.<\/span><a href=\"http:\/\/www.statcan.gc.ca\/tables-tableaux\/sum-som\/l01\/cst01\/health74b-eng.htm\"><span style=\"font-weight: 400;\"> Statistics Canada<\/span><\/a><span style=\"font-weight: 400;\"> says in 2009, 20.8 per cent of the Canadian population smoked. In 2014, the number dropped to 18.1 percent.<\/span><\/p><p><span style=\"font-weight: 400;\">Where is did increase quite dramatically is in Nunavut. In 2009, more than half of the population, 54.4 per cent, reported smoking regularly. By 2014, 60.2 per cent of the population considered themselves smokers.<\/span><\/p><p><span style=\"font-weight: 400;\">The World Health Organization estimates that seventy per cent of the deaths related to tobacco products occur in<\/span><a href=\"http:\/\/www.who.int\/trade\/glossary\/story089\/en\/\"> <span style=\"font-weight: 400;\">developing countries<\/span><\/a><span style=\"font-weight: 400;\">. Those in<\/span><a href=\"http:\/\/www.statcan.gc.ca\/pub\/82-624-x\/2012001\/article\/11676-eng.htm\"> <span style=\"font-weight: 400;\">lower-income<\/span><\/a><span style=\"font-weight: 400;\"> families, including young people, are more likely to smoke.<\/span><\/p><p><span style=\"font-weight: 400;\">So why not just ban tobacco cigarettes altogether and prescribe electronic cigarettes to people who want to overcome the addiction?<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Bhatnagar thinks one of the reasons for this is at least in part because of money.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">In 2014 the federal government made almost $ 3.3 billion from tobacco taxes, according to<\/span><a href=\"http:\/\/www.smoke-free.ca\/pdf_1\/totaltax.pdf\"> <span style=\"font-weight: 400;\">Physicians for a Smoke Free Canada<\/span><\/a><span style=\"font-weight: 400;\">. Including provincial taxes on tobacco the total was more than $8 billion.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u201cUnfortunately, tobacco use was widely established before its tragic health consequences became known,\u201d wrote Sara Lauer, spokesperson for Health Canada, in an email, after being asked why the government does not simply ban tobacco.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cThe idea of banning cigarettes in Canada was first examined in the early 1960s. Today, as in the 1960\u2019s, a ban on tobacco products would be extremely difficult to introduce and enforce, given that tobacco is used by millions of Canadians, many of whom are addicted,\u201d Lauer says.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">While smoking rates in Canada have dropped it would be misguided to think Big Tobacco is out for good. The optics of having Tobacco industry involved in the e-cigarettes business makes one question its intentions.<\/span><\/p><p><span style=\"font-weight: 400;\">Despite his explicit hatred for the Tobacco industry Bhatnagar thinks he would be able to forgive them if they invested in e-cigarettes and moved away from tobacco.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cWhen people don\u2019t know, you must respect that and educate them some other way,\u201d says Hasnain.<\/span><\/p><p><b>MORE THAN ADDICTS<\/b><\/p><p><span style=\"font-weight: 400;\">E-cigarette users are not just smokers looking to quit smoking.<\/span><\/p><p><span style=\"font-weight: 400;\">A most recent<\/span><a href=\"http:\/\/www.sciencedirect.com\/science\/article\/pii\/S0306460316301113\"> <span style=\"font-weight: 400;\">study<\/span><\/a><span style=\"font-weight: 400;\"> on e-cigarettes suggest they can help people with serious mental illnesses quit smoking\u2014i.e. such a schizophrenia or bipolar disorder. According to the study, people with serious mental illnesses have a harder time quitting than people without mental illnesses and may find it more difficult to quit through conventional nicotine replacement therapy.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">They also help other unexpected 180smoke salesperson Keith Hucher says ex-smokers who are feeling the need or urge to smoke come into the shop. He also says asthmatic smokers, diabetics looking for a sweet taste have wanted to try to vape.<\/span><\/p><p><span style=\"font-weight: 400;\">Considering this, and the fact that most vapers are trying to get away from smoking, segregating vapers and asking them to sit at the smokers table may not be the best solution for public health.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">David Sweanor compared sending vapers to a smoking section to sending a recovering alcoholic to an AA meeting at a bar during happy hour. <\/span><\/p><p><b>VIDEO OF VAPERS<\/b><\/p><p><span style=\"font-weight: 400;\">The electronic cigarette as a tool is not the issue and e-cigarettes have shown potential to be a form of harm reduction. Instead, the problem is that unlike bottles of alcohol or needles which deliver the drug to the individual user, vaping is invasive and affects the public.<\/span><\/p><p><span style=\"font-weight: 400;\">Yet, it would be misleading to say and treat vapour the same way as tobacco smoke, because as Sweanor says it deliver a public message that vapour is as harmful as tobacco smoke. Still, because little is still known about the new product it is better to be safe than sorry.<\/span><\/p><p><span style=\"font-weight: 400;\">One possible compromise could be that like safe injection sites, vapers could be given designated areas to vape.<\/span><\/p><p><span style=\"font-weight: 400;\">A report done by the Propel Centre for Population Health Impact, found the top three reasons for using e-cigarettes were to replace regular tobacco cigarettes, to quit smoking, and <\/span><b>t<\/b><span style=\"font-weight: 400;\">he limited restrictions on where they could vape versus smoking. The 2013 study was done before there were regulation on e-cigarettes and so there were more places available to vape than smoke.<\/span><\/p><p><span style=\"font-weight: 400;\">For some, like Michael Hampartzoumian, Ghulam Hasnain and Adey Bailey, e-cigarettes were the only tool that helped them to overcome the temptation and habit of smoking tobacco cigarettes. It halted their addiction to tobacco cigarettes and helped them control their nicotine addiction.<\/span><\/p><p><span style=\"font-weight: 400;\">This project highlighted smokers as addicts struggling with an illness. For some, e-cigarettes help control their nicotine addiction and is a form of harm reduction.<\/span><\/p><p><span style=\"font-weight: 400;\">The debate is about regulation and specifically what should be regulated. For vapers, it\u2019s about what is in the product: what is the e-juice and how safe is their electronic device. For non-smoker advocate groups it\u2019s having a clean air environment.<\/span><\/p><p><span style=\"font-weight: 400;\">Still, some scholars like Stanton Glantz worry that future studies will reveal the dangers of e-cigarettes.
